Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tobobs website, desktop client, engine, and related services (together, the "Platform"), operated by Tobobs ("Tobobs", "we", "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority where you live, you may only use the Platform with the involvement of a parent or legal guardian, who agrees to these Terms on your behalf.

2. Accounts

• You are responsible for all activity that occurs under your account.
• You must provide accurate information and keep your credentials secure.
• You may not share, sell, or transfer your account.
• Notify us immediately at support@tobobs.org if you suspect unauthorized access.

3. User and Creator Content

"Content" means anything you upload, submit, or publish to the Platform, including game code, configuration data, assets, images, usernames, and messages.

• You retain ownership of your Content.
• You grant Tobobs a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, and distribute your Content solely for the purpose of operating, promoting, and improving the Platform.
• You represent that you own or have the necessary rights to all Content you submit.
• This license ends when you delete your Content, except for copies retained in backups or where retention is legally required.

4. Prohibited Conduct

You may not:

• Upload malware, exploits, miners, or code intended to damage, disable, or gain unauthorized access to any system or user device.
• Infringe the intellectual property, privacy, or other rights of any person.
• Post content that is unlawful, harassing, hateful, sexually explicit, or that depicts or promotes violence against real people.
• Attempt to bypass moderation, rate limits, authentication, or security controls.
• Scrape, resell, or redistribute Platform data without written permission.
• Impersonate Tobobs staff or other users.
• Interfere with advertising or attempt to generate fraudulent ad impressions or clicks.

5. Desktop Client and Protocol Handling

Launching a game may open the Tobobs desktop client through a custom protocol link. The client downloads and executes creator-submitted code on your device. While we moderate submissions and apply sandboxing where possible, we cannot guarantee that all third-party content is free of defects. You install and run the client at your own risk.

6. Moderation and Enforcement

We may review, remove, or restrict any Content, and suspend or terminate any account, at our discretion, with or without notice, including for violations of these Terms or for conduct we reasonably believe is harmful to the Platform or its users.

7. Advertising

The Platform is supported by advertising, including Google AdSense. Ads may be served based on your interactions with the Platform and other sites. See our Privacy Policy for details.

8. Fees and Payments

The Platform is currently provided free of charge. If paid features or creator payouts are introduced, additional terms will apply and will be presented before purchase or enrollment.

9. Intellectual Property of Tobobs

The Tobobs name, logo, website, and client software (excluding user Content and any separately licensed open-source components) are owned by us and protected by applicable law. Open-source components are governed by their respective licenses.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that Content will be preserved.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOBOBS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING FROM THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $50.

12. Indemnification

You agree to indemnify and hold harmless Tobobs and its operators from any claims, damages, and expenses (including reasonable legal fees) arising from your Content, your use of the Platform, or your violation of these Terms or applicable law.

13. Termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate access as described in Section 6. Sections 3, 9, 10, 11, 12, and 14 survive termination.

14. Governing Law and Disputes

These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-law rules. Disputes will be brought exclusively in the courts located in [VENUE], unless applicable consumer law grants you a different forum.

15. Changes to These Terms

We may update these Terms. Material changes will be announced on the Platform. Continued use after the effective date constitutes acceptance.
